Maternity leave is mandatory for all mothers after the birth of a child. However, it is possible to transfer part of this leave to the father. Why give up maternity leave if a woman gets another pregnancy during it?

Maternity leave- general rules

According to current legislation, maternity leave is granted to insured persons and is mandatory for all mothers of at least 14 weeks. This time increases if more than one child is born. If one child is born, maternity leave can last 20 weeks. 6 weeks, on the other hand, the mother can donate to the father in the form of a so-called “gift”. paternity leave.

Maternity leave is a paid leave. Mom receives benefits of 100% of the benefit base for 6 months and 6 weeks of parental leave, and then 60% or for 12 months 80%. Besides, while on maternity or paternity leave, you cannot be fired by your employer unless it declares bankruptcy.

Maternity leave or sick leave?

Many women become pregnant again while on maternity leave. The amounts paid for maternity or parental leave vs. on sick leave differ. Due to the fact that during maternity leave a woman would receive, for example, 60% or 80% of the benefit base, and during sick leave 100%, it is best, in the event of another pregnancy, to forgo maternity leave and, if there are indications to do so, go on sick leave. This can be done only after the mother-to-be has used 14 weeks of maternity leave.

Pregnancy on maternity leave-formalities

If a woman has another pregnancy and wants to give up her leave, she must submit a statement of resignation at least 7 days before she is scheduled to return to work. When health contraindications to return are present, she can show the employer a sick leave. In addition, it is possible to transfer the remaining leave to the child’s father.

Parental leave and pregnancy

Parental leave lasts up to 32 weeks after the birth of one child. For the first 6 weeks of parental leave, Parents receive 100% of the benefit base, and 60% for the following 6 weeks. You can leave parental leave at any time and return to work, or you can go on sick leave due to pregnancy (and concurrent contraindications to return to work). For many people, it is more profitable because they receive a benefit of 100% of their benefit base during sick leave.
